Terms of Service

These Terms of Service ("Terms") govern access to and use of Wrecker OS, hosted tenant websites, customer portals, staff tools, and related online services. When you use a tenant public website, request towing service from Your Towing Company, or subscribe to the Wrecker OS software platform, you agree to these Terms.
1. Roles and services
Wrecker OS provides software used by towing companies to manage dispatch, driver workflows, public websites, online booking, impound records, customer portals, invoices, payments, communications, and related operations. Tenant towing companies are responsible for the towing, roadside, storage, impound, lien, auction, customer-service, and employment activities they perform through the platform.
2. Accounts and authorized users
Tenant administrators are responsible for managing staff access, assigning appropriate roles, keeping credentials confidential, promptly removing users who no longer need access, and reviewing activity for their organization. You may not share accounts, impersonate another person, bypass tenant boundaries, or attempt to access another company's data.
3. Tenant responsibilities
Tenants are responsible for the accuracy of their business profile, rates, service areas, public website content, customer notices, legal forms, storage fees, lien deadlines, auction workflows, employment materials, and any messages sent through the platform. The platform may provide templates, tools, and automation, but those features do not replace legal, accounting, tax, insurance, motor-club, law-enforcement, or regulatory advice.
4. Customer requests and service estimates
Online booking, tracking, impound lookup, police lookup, and account portal tools are intended to help collect and share operational information. Prices, release amounts, ETAs, availability, and vehicle status may be estimates unless confirmed directly by the towing company. Emergency conditions, traffic, weather, police holds, incomplete records, and payment processing timing can affect service and release details.
5. Subscription, payments, and pass-through costs
Unless a written agreement says otherwise, the standard Wrecker OS software plan is $50 per month for included platform features. Third-party or usage-based costs, such as payment processing, maps, domains, messaging, lien searches, hardware, accounting systems, or external network fees, may be charged or passed through separately when used.
Customer card payments are processed by third-party payment providers. Tenants are responsible for the goods and services sold, refunds they authorize, chargeback responses, taxes, and any required customer disclosures.
6. Content, photos, and records
Users may upload or store job notes, vehicle details, driver photos, damage reports, signatures, invoices, documents, impound records, chat messages, website content, and other business records. You represent that you have the right to submit that content and that it is accurate to the best of your knowledge. You must not upload unlawful, misleading, malicious, or infringing content.
7. Acceptable use
You agree not to use the services to:
- Violate any law, court order, police hold, privacy obligation, or third-party right
- Access, copy, scrape, or interfere with another tenant's data or public site
- Upload malware or attempt to disrupt the platform, hosting provider, or payment systems
- Send misleading, abusive, harassing, or unauthorized commercial communications
- Misrepresent fees, vehicle status, release conditions, or service availability
8. Third-party services
The platform may connect to hosting, database, email, analytics, mapping, payment, communication, domain, file storage, and other third-party providers. Those providers may have their own terms and privacy practices. We are not responsible for third-party services outside our control, but we design the platform to use them in support of towing operations.
9. Demo sandbox
Demo or sandbox environments are provided for evaluation and training. Sandbox data may be reset, overwritten, or removed on a scheduled basis and should not be used for live towing operations, real customer payment collection, regulated impound deadlines, or long-term recordkeeping.
10. Availability and changes
We work to keep the services available, secure, and useful, but uptime, integrations, and individual features can be affected by maintenance, hosting providers, network issues, third-party outages, or emergency fixes. Features may be changed, added, or removed over time as the platform improves.
11. Privacy
Our data practices are described in the Privacy Policy and Cookie Policy. Tenants are responsible for making sure their own notices, customer forms, and operating practices match how they use the platform.
12. Suspension and termination
Access may be suspended or terminated for non-payment, security risk, suspected misuse, legal requirements, tenant closure, or violation of these Terms. Tenants should export or preserve records they are legally required to retain.
13. Disclaimers and limitation of liability
The services are provided on an "as is" and "as available" basis to the fullest extent allowed by law. We do not warrant that the platform will be uninterrupted, error-free, or suitable for every regulatory requirement in every jurisdiction. To the fullest extent allowed by law, we are not liable for indirect, incidental, special, consequential, punitive, lost-profit, lost-data, or business-interruption damages.
14. Updates to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect the latest version. Continued use of the services after updates means you accept the revised Terms.
